End-User License Agreement ("Agreement")

This limited software warranty and End-User license agreement (this "Agreement") may be periodically updated and the current version will be posted at https://www.cottoncandycyanide.com/eula/ (the "Website"). Your continued use of the Software after a revised Agreement has been posted constitutes your acceptance of its terms.

 

The “Software” includes all software included in this agreement. This includes, but is not limited to, related services, manual(s), packaging, other written files, electronic or on-line documentation and any and all copies of such software and its materials. 

 

This Software is licenced, not sold. Please read this Agreement carefully before using the Software. By opening, downloading, installing, copying or otherwise using the Software, you agree to be bound by the terms of this agreement with the Australian company Cotton Candy Cyanide Pty.Ltd. (“Licensor”).

 

If you do not agree to the terms of this Agreement, do not open, download, install, copy or otherwise use the software.

 

License

 

Subject to this Agreement and its terms and conditions, the Licensor grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Software solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

 

Restrictions

 

You agree not to, and you will not permit others to:

 

a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Software or make the Software available to any third party.

Modifications to Software

 

The Licensor reserves the right to modify, suspend or discontinue, temporarily or permanently, the Software or any service to which it connects, with or without notice and without liability to you.
 

Term and Termination

 

This Agreement shall remain in effect until terminated by you or the Licensor. 

 

The Licensor may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

 

This Agreement will terminate immediately, without prior notice from the Licensor, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Software and all copies thereof from your all your devices and storage devices, including cloud storage.

 

Upon termination of this Agreement, you shall cease all use of the Software and delete all copies of the Software from your devices.
 

User Created Content

 

The Software may allow you to create content, including, but not limited to, screenshots, video of gameplay or fanfiction. In exchange for the use of the Software, you hereby grant the Licensor an exclusive, perpetual, irrevocable, fully transferable, and sub-licensable worldwide right and licence to use your contributions in any way for any purpose in Connection with the Licensor and any related goods and services, including, but not limited to, the rights to reproduce, copy, modify, display by any means chosen by the Licensor. Your contributions are not required to be expressed nor will you be compensated for any created content.

 

You hereby waive and agree never to assert and moral right of paternity, publication, reputation, or attribution of any user created content.This license grants the Licensor the terms within the “user created content” section and any applicable moral right, will continue even after termination of this Agreement by any party.

 

Severability

 

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

 

Amendments to this Agreement

 

The Licensor reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 7 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

 

Miscellaneous

 

If you obtain this Software via file sharing or other bad faith methods, you are not only bound by this Agreement (which is accessible at https://www.cottoncandycyanide.com/eula/) but you are also required to purchase a copy via the Steam platform (on sale is acceptable), leave a five star review, and in the review section write: “Oh Boy, this game is the bee’s knees. Honest.”
